Hospital Leaders Remain Confident Unfair Labor Charges Will Be Dismissed

GENESEE COUNTY, Mich. — The National Labor Relations Board (NLRB) last week dismissed an unfair labor practice charge filed by the International Brotherhood of Teamsters against Henry Ford Health Genesys Hospital following a comprehensive investigation by the agency’s Region 07 office in Detroit.

In a decision dated April 7, 2026, the NLRB found no violation of the National Labor Relations Act in case number 07-CA-379127, concluding that Genesys Hospital acted lawfully and in good faith during collective bargaining negotiations and the union’s ongoing strike could not be declared an unfair labor practices (ULP) strike based on the charge.

After the ruling, the union and its representatives falsely claimed through spokespeople and on social media that the Teamsters had filed “a dozen” of unfair labor practice charges against Henry Ford Genesys Hospital. 

The truth is that eight of the remaining cases connected to Genesys Hospital were filed by the union between May 2022 and September 2024, while the hospital was operated by Ascension Michigan, and are unrelated to the current labor dispute. Henry Ford Health assumed operations of the hospital in October 2024 and cannot, by law, be held accountable for the actions of prior operators. 

Since assuming operations in October 2024, system leaders have conducted a thorough review of hospital operations and have been working with hospital leadership to implement practices proven to foster a culture in which every team member feels valued and supported. A recent survey conducted by Press Ganey, an independent company specializing in experience surveys, reflects those improvements. 

Press Ganey data shows that registered nurses working at Genesys Hospital through the strike reported an average job satisfaction score of 4.16 out of 5 in the fourth quarter of 2025. The average national RN satisfaction score is 3.91. Before the Teamsters strike, nurses at Genesys Hospital reported a job satisfaction score of 3.41.  

The board continues to investigate four other claims filed by the union against Henry Ford Genesys Hospital. Attorneys for the health system say they expect those cases to be dismissed. 

The NLRB’s April 7 decision supports what the hospital has said all along: the union’s claims of unfair labor practices are nothing more than an attempt to get leverage at the bargaining table.

The charge rejected by the NLRB in early April alleged Henry Ford Genesys Hospital failed to provide health insurance information to the union’s bargaining team and therefore improperly declared an impasse in ongoing contract negotiations.

Investigators concluded that the hospital raised “legitimate” confidentiality concerns related to the Health Insurance Portability and Accountability Act (HIPAA) and made good‑faith efforts to accommodate the union’s request for health insurance information for its members and their families by offering multiple alternatives and proposing a confidentiality agreement. The union declined those accommodations.

When grievances are deferred to arbitration, the NLRB suspends its investigation. If the issue is resolved through arbitration, the NLRB typically dismisses the charge.
